O contrato de comodato é um tipo contratual previsto no Código Civil.
Então o que é um contrato de comodato?
O contrato de comodato é um contrato gratuito, pelo qual uma das partes entrega à outra uma coisa, móvel ou imóvel, para que este se sirva dela, com a obrigação de a restituir.
As duas partes do contrato são:
> O comodante (quem entrega o bem)
> O comodatário (quem recebe o bem)
É uma forma gratuita, uma vez que não tem associado o pagamento de qualquer contrapartida direta pelo empréstimo do bem.
A duração é decidida pelas partes, não havendo limite temporal
❕ Se tiver limite de tempo > no final do prazo estipulado, o bem móvel ou imóvel, deverá ser restituído, nas mesmas condições em que lhe foi entregue.
❕ Se não tiver limite de tempo > o contrato produzirá efeitos até que uma das partes o denuncie, sendo o comodatário obrigado a restituí-lo logo que este lhe seja exigido.
❕ Se não tiver limite de tempo, mas determinação do uso > este deverá ser restituído logo que o uso termine, ainda assim, o contrato pode ainda ser resolvido, mediante justa causa.

The lending contract is a type of contract provided for in the Civil Code.
So what is a lending contract?
A lending contract is a free of charge contract whereby one of the parties gives the other a movable or immovable item so that the latter can use it, with the obligation to return it.
The two parties to the contract are:
> The lender (who delivers the good)
> The lessee (who receives the goods)
It is free of charge, as there is no direct payment for the loan of the goods.
The duration is decided by the parties and there is no time limit
❕ If there is a time limit > at the end of the stipulated period, the movable or immovable property must be returned in the same condition as it was delivered.
❕ If there is no time limit > the contract will take effect until one of the parties terminates it, and the lessee is obliged to return it as soon as it is demanded.
❕ If there is no time limit, but the use is determined > it must be returned as soon as the use ends, although the contract can still be terminated for just cause.
